HOW CAN I ASSIST YOU IN LITIGATION?

        I am often asked to perform a  neuropsychological medical case review in the early stages of litigation to help evaluate the merits of a case.  I provide you with an objective assessment as to the case's weaknesses and strengths.  As the case proceeds, I can then provide you with a case  stratagem, a detailed case report, and ultimately testimony if required.  This procedure is very cost-effective for attorneys and their clients in case negotiations, arbitration, or litigation.  There is no charge for my initial telephone discussion with you (reverse charge outside Connecticut.)

 

WHAT IS MY USUAL PROCEDURE FOR CASE REVIEW ?

       The usual way I handle a case with the allegation of traumatic brain injury is first to review all available medical records.  This is often supplemented by school records and employment evaluations to document the person's usual level of functioning.  The claimant's statements regarding the event are reviewed to see if the occurrence could reasonably be linked to the symptoms experienced. 

        Neurological, orthopedic and psychiatric records are carefully examined to determine if the signs do or do not support the existence of a head injury and whether there are other conditions that might account for the signs and symptoms.  Many times this is the extent of my involvement in a case.  My opinion is given to the defense or plaintiff's attorney;  it is generally shared with opposing counsel.

         At times, further evaluation is appropriate.  If a neuropsychological assessment is called for,  I can perform it locally.  Referral to other appropriate professionals could also be made at that time if another area of expertise or a different region of the country is required.

 

WHAT IS MY FEE SCHEDULE  ?

       A written fee Memorandum is provided to each of my clients which provides my specific rates for medical case  review, research, report preparation, telephone consultation, travel, deposition, pre-hearing consultation, and trial testimony. The Memorandum will specify the method and timing of payment.   After the initial medical case review I will provide you with an estimated cost of service for the project.  This will allow you and your client to determine if my charges meet your case budget and  are commensurate with the possible value of your case.  And, there is no charge for my initial telephone discussion with you (reverse charge outside Connecticut.)
